Terms of Service

Welcome to PodCrisp. These Terms of Service ("Terms") govern your use of the PodCrisp website and service located at podcrisp.com (the "Service"), operated by Haimo ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

By submitting a podcast URL (RSS feed, Apple Podcasts link, YouTube link, or any other source) to PodCrisp, you represent and warrant that:

You acknowledge that PodCrisp is a tool, not a publisher, and that responsibility for the lawfulness of the input rests with you, the user. You agree to indemnify and hold harmless PodCrisp, Haimo, its operators, contractors, and affiliates from any claim, damage, attorney fee, or expense arising out of or related to your breach of the warranties in this section.

3b. Repeat Infringer Policy (DMCA §512(i))

Pursuant to 17 U.S.C. §512(i)(1)(A) and Articles 14/16 of the EU Copyright Directive 2019/790, PodCrisp maintains a policy of terminating, in appropriate circumstances, the accounts of subscribers who are repeat infringers:

  1. First Notice — Upon receiving a substantively compliant takedown notice identifying a user’s submission, the targeted summary is removed from public access within 24 hours, the user receives a written warning, and the source RSS URL is added to our internal opt-out list (preventing re-submission).
  2. Second Notice (same user) — Account immediately suspended pending review. User is notified by email and may file a counter-notice under DMCA §512(g).
  3. Third Notice or Pattern of Bad-Faith Submissions — Account permanently terminated; no refund of unused subscription credits; the user is added to our internal banned-user list.

Takedown notices and counter-notices may be filed by emailing dmca@podcrisp.com. We respond to substantively compliant notices within 24 hours of receipt during business days (response service-level objective, not a contractual guarantee).

4. AI-Generated Content

Important: All summaries, takeaways, chapter timestamps, and action items generated by PodCrisp are produced by artificial intelligence systems. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies. Users should verify critical information independently.

5. Subscriptions and Payments

PodCrisp offers subscription plans billed through our payment processor Dodo Payments.

5.1 Pricing and Billing

All prices are in USD and subject to change with 30 days' notice.

5.2 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled. You authorize recurring charges to your payment method on file.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods, except as stated in §5.4 below.

5.4 Refund Policy — 7-day Money-Back Guarantee

We offer a 7-day money-back guarantee on your first paid month, no questions asked. If you request a refund within 7 days of your initial paid subscription, we will process a full refund via Dodo Payments. To request a refund, email hello@podcrisp.com from your registered account email. Refunds after the 7-day window or for renewal periods (beyond the first paid month) are not provided, except where required by applicable consumer law.

6. EU Consumer Rights

If you are located in the European Union, you have additional rights under EU consumer law:

Prohibited Regions: PodCrisp is not offered to users in mainland China, Hong Kong, Macau, or Taiwan. Users from these regions are prohibited from using the Service. By using PodCrisp, you represent that you are not located in, and will not access the Service from, these regions.

8. Intellectual Property Rights

8.1 Our Content

The Service, including but not limited to its design, text, graphics, software code, and user interface, is owned by Haimo and protected by intellectual property laws.

PodCrisp generates summaries that may involve copyrighted podcast content. Our service is designed for fair use purposes including:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated summaries will be accurate or complete.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:
